Division of Solid Waste Enforcement

The Division of Solid Waste Enforcement is authorized to enforce provisions of the Solid Waste Management Act and the Union County District Solid Waste Plan. Enforcement Officers within the Division conduct inspections and/or investigations of authorized and unauthorized solid waste facilities, solid waste transporters, recycling facilities, and investigate complaints generated within Union County.

If an investigation reveals solid waste violations that require further enforcement action, a Notice of Violation (NOV) may be issued. For violations of solid waste laws that have adopted “grace period” rules, a follow-up inspection is conducted after an appropriate compliance period. Continual non-compliance or waste flow violations may result in a Notice of Violation with a penalty assessment (NOVPA) or a court summons and complaint depending on the severity of the violation and the violator’s history of non-compliance.
